TERMS & CONDITIONS

Standard terms & conditions apply only to UK mainland deliveries.

By using the Ashton Outdoors site and by ordering products from Ashton Outdoors by phone, fax, post or website, you are agreeing to be bound by the terms & conditions set out in the following paragraphs. If you do not agree with these terms and conditions without modification, then you should not use this website. A tick box is included on the final transaction window before the sale is confirmed which asks you to confirm your understanding of the terms and conditions before completing your order.

ORDERING

We will do our best to ensure that the website reflects the stock levels of the company but some products will inevitably sell out very quickly, therefore, placing an order with us does not guarantee availability. We will, of course, make every effort to fulfill your order and if this is not possible we will let you know as soon as possible. Alternatively, to avoid disappointment you can contact us on 0161 343 2151 speak to a member of staff and check availability.

We must receive payment for the whole price for the Goods (including any delivery charge) before your order can be accepted.

Once we have received payment we will confirm that your order has been received by sending a confirmation e-mail to you at the e-mail address you provide on your order form. Our acceptance (all orders are checked prior to acceptance) of your order brings into existence a legally binding contract between us – you, the customer and us – Ashton Outdoors Ltd.

PRICES

The prices payable for Goods are as set out on our website. The prices on www.ashtonoutdoors.co.uk include V.A.T. and are checked for accuracy. Occasionally errors may occur where prices are incorrectly displayed or change as a result of circumstances beyond our control. In those situations, you will be informed of the correct/revised prices once we receive your order, and if you should not wish to purchase the product concerned at that price we will cancel that part of the order. You will be required to pay extra for delivery. Our delivery charges are set out on the delivery page of our website.

COLOURS

Whilst every effort has been made to present the true likeness of the product colours, variations may occur on different screen resolutions and qualities. We therefore cannot guarantee colours will be as seen on your screen.

DELIVERY OF GOODS

We will deliver the Goods to the address you provide us with for delivery on the order form. (Please note that Credit Card orders must be delivered to the Credit Card address)

We will make every effort to deliver the Goods as soon as possible and you will be notified if there is any lengthy anticipated delay.

Orders accepted on a Friday will not ordinarily be dispatched until the following Monday unless you have requested and paid for a Saturday delivery.

You will become the owner of the Goods when they have been delivered to you. Once the Goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction. (Please note that if you have an arrangement for goods being left, then this will be at your own risk not ours)

RETURNS

Goods which prove to be unsuitable or not required, can be returned for a prompt refund or exchange if they are received back at our Mail Order Department within 14 days in new condition, with the original packaging, labeling, and Ashton Outdoors receipt. The return of these goods will be at the customer’s expense. We recommend that items being returned are sent via insured, traceable delivery for your protection.

RIGHT TO CANCEL YOUR ORDER

You may cancel your order with us for the Goods at any time up to the end of the seventh working day from the date you receive the Goods. (Does not apply to special order items)

You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.

You cannot cancel your contract if you have used the Goods and caused wear or damage;

To cancel your contract you must notify us in writing at our address.

Once you have notified us that you are cancelling your contract, any sums paid to us for the Goods (but not the delivery charges) will be returned to you or re-credited to your account as soon as possible.

If you have received the Goods before you cancel your contract then you must send the Goods back to us at your own cost and risk. If you cancel your contract but we have already processed the Goods for delivery you must not unpack the Goods when they are received by you and you must send the Goods back to us at your own cost and risk within 7 days of delivery.

CANCELLATION BY US

We can cancel the contract between us if within seven working days from the date we accepted your order we:

Do not have sufficient stock to deliver the Goods;
We do not deliver to your area; or
One or more of the Goods was listed at an incorrect price/description due to a typographical error.

If we do cancel your contract we will notify you by e-mail and will return to you any sums paid as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment or inconvenience suffered.

GUARANTEES

Where Goods are supplied with a manufacturers’ guarantee any claim under the guarantee should be made directly to the manufacturer or authorised UK distributor of the product. This does not affect your statutory rights as a consumer. Out of Box Faults will always be replaced as soon as the item has been returned and checked for faults.

LIABILITY.

If the Goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing at our address of the problem within 7 working days of the delivery of the Goods.

If you do not receive Goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our address below of the problem within 40 days of the date on which you ordered the Goods.

USE OF THE ASHTON OUTDOORS WEBSITE

Ashton Outdoors provides this website for your personal use. You may not use it commercially or modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any content, information, products or services obtained from this site.
